Volgograd court cancels arrest of person who raped 13-year-old girl due to lack of access to interpreter
The accused graduated the primary school and has a poor command of Russian.
Volgograd’s Regional Court overturned the decision of the Gorodishchensky District Court on the arrest of a native of Azerbaijan and citizen of the Russian Federation, Hayal Mamedov, 34, who is accused of raping a 13-year-old schoolgirl. The defendant graduated only the primary school and allegedly has a poor command of the Russian language, but he was not provided with an interpreter, which the appellate court considered to be a violation of Mamedov’s rights, V1.ru reports.
According to investigators, on February 1, taxi driver Mamedov asked a schoolgirl to show how to leave Gorodishche, took the girl to the outskirts, raped her, and then drove her home. The girl told everything to her mothers, and after an hour and a half Mamedov was detained.
The defendant claims that he comforted the girl after parting with her boyfriend by her consent and did not know about the fact that she was a minor. During the investigation, Mamedov repeatedly changed his testimony.
On March 21, the accused must be released from arrest. Later, the Grodischensky Court will again consider the petition of the investigation to arrest Mamedov.
The Prosecutor General's Office had earlier accused the Moscow region’s ex-official of exceeding official authority, taking a bribe on an especially large scale, and forgery, and demanded to seize assets worth of 9 billion rubles ($135 million) from him.
