Sensational case of pedophiles' gang to break up through illegal actions of investigators
The members of the Ingush gang, surrounded by influential relatives, entrusted the lawyer with enormous constraints in the judicial system of the Rostov region to minimize the penalty.
Ingush members of the pedophiles' gang, who committed sexual assault against a 7-year-old child, make every attempt to destroy the criminal case in court. According to the source of the CrimeRussia, Abukar Polonkoev's relatives hired lawyer Eduard Egoyan, who is a great expert and a man of enormous constraints in the judicial system of the Rostov region, to protect him. Note that in 2014 Polonkoev was sentenced to 16 years of imprisonment for pedophilia. In the course of further investigation it was found evidence of his participation in illegal armed formations on the territory of Ingushetia and Chechnya. A criminal case was initiated under part 2 of Art. 208 and part 3 of Art. 222 of the Criminal Code.
Currently, Egoyan attempts to remove evidence, the Polonkoev's documents with the results of test on polygraph. And he passed through the detector twice. First test's results were a proof of his guilt. The second procedure gave the basis for the evidence in relation to other participants in the crime. In particular, according to the source of the CrimeRussia, the task of the lawyer is to prove that the documents were obtained illegally.
According to a source from the security forces, it is difficult to challenge the results of the polygraph test. However, it's possible to exclude them from the evidence base, if the judge determines that documents, proving the illegality of the investigation, are found to be credible. The exclusion of polygraph's evidence entails a whole series of procedural decisions that can destroy the case. This, of course, does not mean that the accused are completely gone from liability, but it mitigates their punishment as much as possible.
The rest of the suspects' lawyers of in this case will no longer play a key role. On the effort of Edward Egoyan it depends on how the entire judicial process will be developed.
Recall, in the period from September 2009 to April 2010, A.M. Polonkoev, I.I. Dakiev, A.M. Ozdoev, A.U. Nagoev, M.B. Daurbekov, and M.R. Aushev., all of the perpetrators together committed sexual assault against a 7-year-old child. During raping, the child received physical and psychological trauma that comes under Art. 111 of the Criminal Code. In addition, the persons involved were charged under part 4 of Art. 135 of the Russian Criminal Code (Sexual Abuse), item (b) part 4 of Art. 132 (Violent Actions of Sexual Character), part 1 of Art. 119 of the Russian Criminal Code (Threat of Murder or infliction of grave injury to health), etc. To date, only Polonkoev has been convicted for his crime - the court found him guilty and sentenced to 16 years in a maximum security penal colony.
As for the other defendants, controversial Prosecutor Ivan Sydoruk supervising the investigation did not see sufficient grounds for legal action, although, the evidences in the indictment against Polonkoev and in the decision to dismiss the case against his accomplices were the same.
After a number of attempts to cover up a criminal prosecution, the indictment was signed. But it happened 5 years after the case was opened. During this time, according to the source of the CrimeRussia, in an attempt to free the accused from liability various ICR and Prosecutor's Office officers partook. Each of them has powerful relatives among the officials, judges and businessmen in Ingushetia. The investigation was strongly delayed. Testimonies and evidences disappeared from the case. 16 most important evidence of defendants' guilt, including the record of the confrontation with the victim boy's video, were not simply included in the case file.
In the autumn of 2016, the Supreme Court was able to change the venue of trial and transfer the case from Ingushetia to the North Caucasus District Military Court in the city of Rostov-on-Don.
As a result, four of the six accused of pedophilia were in the dock. Ozdoev died of natural causes during the investigation. He suffered from coronary heart disease, he did not warned investigators about that. Daurbekov is still hiding from the investigation on the territory of the Republic of Kazakhstan.
On December 20, 2016 a preliminary hearing was held. The case is read by principled and integrity judge Vyacheslav Korsakov. The first official hearing will be held on 17 January of 2017.
