Russian Deputy of Prosecutor General is possibly trying to topple pedophiles gang's case
Several years ago, the leading media editions reported about the monstrous crime, committed against a minor Ingush boy, who had been molested for a long time by a gang of pedophiles. Eventually, the criminals were arrested, but the story did not end there. Instead, it astonishingly evolved, with Russian Deputy of Prosecutor General I.I. Sydoruk doing his best to stop criminal proceedings against the perpetrators. The CrimeRussia will let you in on details in the following article.
At the moment, the ICR Central Investigation Department in the North Caucasus Federal District is investigating a criminal case №13520009 against A.M. Polonkoev, I.I. Dakiev, A.M. Ozdoev, A.U. Nagoev, M.B. Daurbekov, and M.R. Aushev. In the period from September 2009 to April 2010, all of the perpetrators together committed sexual assault against a 7-year-old child. Moreover, in the course of further investigation, it was proved that Polonkoev participated in an illegal armed group on the territory of Ingushetia and Chechnya. He then became a defendant in a criminal case under part 2 of art. 208 and part 3 of art. 222 of the Russian Criminal Code.
As a result of the pedophiles’ criminal actions, the child suffered psychological trauma and serious bodily injury, which falls under art. 111 of the Russian Criminal Code. In addition, the persons involved were charged under part 4 of Art. 135 of the Russian Criminal Code (Sexual Abuse), item (b) part 4 of Art. 132 (Violent Actions of Sexual Character), part 1 of Art. 119 of the Russian Criminal Code (Threat of Murder or infliction of grave injury to health), etc. To date, only Polonkoev has been convicted for his crime - the court found him guilty and sentenced to 16 years in a maximum security penal colony. This was made possible only due to the best efforts of the boy's parents and the lawyers representing their interests. Polonkoev’s five accomplices to this day have not suffered any penalty. According to a source of the CrimeRussia, the Russian Deputy of Prosecutor General is the one, who puts a spoke in wheel.
All the accused are currently familiarizing with the case. However, to the surprise of the investigation, the Deputy of Prosecutor General I.I. Sydoruk, who oversees the case, replaced the former prosecutor of the ICR Investigation Department in the North Caucasus Federal District, I.A. Shvetsov, with another prosecutor, D.V. Mironov. Without even studying the materials of the case, the latter immediately stated that Polonkoev’s participation in an illegal armed group was proven wrong and therefore a criminal case against him under part 2 of Art. 208 and part. 3 of Art. 222 of the Russian Criminal Code must be stopped.
At the same time, the case file indicates that the victim identified Polonkoev, that the Federal Security Service (the FSB) presented its own evidence, and that even a polygraph session was conducted, proving that the defendant was an active member of the armed gang. Moreover, a witness saw the pistol, which Polonkoev used to threaten the child during rape, in the woods when the defendants was a member of an illegal armed formation.

According to the source of the CrimeRussia, the sudden and totally unmotivated replacement of the prosecutor is not the only disputable decision Sydoruk has made. This may indicate that the official is interested in toppling the case against the rapists and achieving their subsequent release.
For instance, since the criminal proceedings had been initiated, specifically on September 17, 2011, some members of the Investigative Committee and the Prosecutor's Office initially attempted to stop the persecution of the accused. On the personal testimony of the lawyer of one of the rapists, A.A. Gorchkhanova, this was done for a considerable sum of money. Law-abiding investigators and relatives of the victim had persuaded prosecutor A.U. Govorunov to finish the investigation against at least one member of the pedophile gang, A.M. Polonkoev, who was eventually sentenced to 16 years in prison by the Krasnodar Regional Court. Even then, the judge of the regional court V. Kobzev was surprised and outraged by the fact that other participants in the crime – Aushev, Dakiev, and Nagoev - were relieved from liability, although the evidence of their guilt had been presented in its entirety. However, the supervising prosecutor for the case, Sydoruk, ignored them and considered the termination of criminal proceedings legal.
The decision to dismiss the case against the three criminals and the indictment against Polonkoev featured identical pieces of evidences.
The investigator also discharged from the criminal case 16 other vital pieces of evidence against the defendants, including the show-up with the video, on which the victim fully exposed A.U. Nagoev. By the way, for some unknown reason this video disappeared from the case, but fortunately, the boy’s relatives saved it.
At that time, nobody gave the assessment of the actions of those pedophiles against another child. Curiously, this fact dropped out of sight of the watchful eye of public prosecutor, the source of the CrimeRussia noted.
With all these violations, the Deputy of Prosecutor General Sydoruk confirmed the indictment against Polonkoev and did not notice the gross violations of law in the termination of criminal proceedings against the other criminals, letting them go free.
Ultimately, after more than two years, the perpetrators were detained on the basis of the same case materials. When on May 19, 2015, Sydoruk finally agreed to initiate criminal proceedings against all of the pedophiles under item (a) part 3 of Art. 111 and part 4 of Art. 135 of the Russian Criminal Code, they had already committed several other crimes.

How can we explain this apparent delay in the case against pedophiles? What else must happen in order to finish the investigation, which has already lasted for five years, and send it to the court? In all these years, the victims have been receiving threats from relatives of the rapists. Therefore, they had to receive state protection and were forced to move into other regions of the country.
The guilt of all 6 members of the pedophile gang was proven beyond reasonable doubt. The molested child identified his tormentors. Among other things, the investigation found a napkin with the blood of the child and obtained the results of the psychological examinations, which proved that the boy was telling the truth.
Each year, Russian law enforcement officers report a significant increase in the number of crimes against sexual integrity of children. At the same time, there is no accurate annual data on how many children become victims of perverts. The real figure is greater than that shown in the statistics, since the majority of cases are not even reported to the police. While the concerned society is wondering what causes such degradation, we think that we have presented one in this article.
