Judge of Chechen Arbitral court became defendant in criminal case
The representatives of Themis accused of pronouncement of ‘obviously illegal decision’.
The chairman of the Investigative Committee of the Russian Federation initiated a criminal case against judge of Arbitration court of the Chechen Republic Alou Bachayev under the article ‘Pronouncement of obviously illegal decision’, the press service of the Investigative Committee reports.
As the investigation assumes, the suspected on May 4, 2010 and on August 28, 2012 passed obviously illegal decisions, satisfying claims of the Simbioz Association non-profit organization about collecting more than five billion rubles from the Russian Federation.
Law enforcement authorities established that Bachayev intentionally missed from attention the fact that created in 2002 Simbioz association was actually a right successor of the association of Simbioz cooperatives operating in the 90s. Further for lack of legal basis Bachayev recognized succession of new Symbiosis on the real estate object transferred to the federal possession and on receiving compensation for oil products, undelivered in 1991.
It is noted that the highest qualification board of judges of the Russian Federation already satisfied idea of the chairman of ICR of initiation of legal proceedings. This decision is left appeal definition of the Supreme Court of the Russian Federation without change and has taken legal effect.
