Two months past since the moment when scandalous conductress of the Investigation Directorate of the Investigation Committee across the Novgorod Region Ekaterina Gilina was transferred to work to St. Petersburg by the order of the administration. However consequences of her long-term ‘works’ puzzle not only Central office of Investigative Committee, but also the Supreme Court of the Russian Federation today.

Disloyal letters

The CrimeRussia has already mentioned peculiar methods of work of Ekaterina Gilina. She, for example, was not confused by such things as execution of service duties by the persons which are not certified by IC and working in the department, violating of both the labor law, and internal rules and procedures. n particular, the order of the Investigative Committee of the Russian Federation No. 114 of 08.08.2011 “About an order of position assignment, dismissal and dismissal of the employees and workers performing professional activity by professions of workers of Investigative committee of the Russian Federation”.

As the CrimeRussia earlier reported, nine employees of the Novgorod IC addressed the Russian President and the head of his administration of Eduard Vayno with the letter in which they in detail told about violations, which were created in the department.

Certain employee: “... for more than 6 months directed the Low-Vishera interdistrict Investigative Department of the Investigation Directorate ******, approving indictments, prolonging terms of pretrial investigation and content of defendants under guards, however at the same time he was not an employee of the Investigative Committee of Russia. 15.01.2016 terminal labor contract of ****** and the order of the chairman of IC of Russia giving him appropriate authority expired, however Gilina E. G. in defiance of the labor law and departmental orders did not send the relevant documents on prolongation of powers to him, and allowed him to work, just on oral specifying. These violations ****** became known in July, 2016 when Gilina E. G. required him to leave since the central office of IC of Russia knew of this violation...”.

This letter was certainly read also by the direct head of ICR − Alexander Bastrykin. Now the similar letter is sent to the address of the chairman of the Supreme Court of the Russian Federation Vyacheslav Lebedev and the chairman of the Novgorod regional court Inna Samylina. There it in particular specified gross violations of the penal procedural legislation in Investigation Directorate of IC across the Novgorod Region. It is exactly about that six-months old episode when the employee ****** fulfilled duties without prolongation of the labor contract. The matter is that this person investigated a number of crimes of varying severity in defiance of part 5 Art. 39 of the Code of Criminal Procedure of the Russian Federation – because, as it was discovered later, no one had allocated such powers to him. He bore the service only according to the personal oral order of Ekaterina Gilina who allegedly had a lack of time to be engaged in paper work, and official appointment of the employee was postponed. Besides, this fact was very convenient to her subsequently to ‘shade’ the story with illegal initiation of legal proceedings concerning the head of administration of the Low-Vishera district Nikolay Maslov which, by the way, was scattered subsequently. But that worker who officially just did not exist in Novgorod IC shall bear responsibility for all this. ‘Dead souls’, in a word.

The most sad in this bureaucratic story − that, according to part 6 Art. 220 of the Code of Criminal Procedure of the Russian Federation, criminal cases which were investigated by the inadequate person could not be directed to the prosecutor and should not get to court. And they were directed and got. And sentences on these affairs, of course, are pronounced. As the CrimeRussia discovered, today there are 38 such cases.

The future of the unfortunate employee who by Gilina's will continued to work regularly was unenviable. As soon as the Central office of ICR knew of these violations, Gilina demanded him to leave to rumple a bad story (it was in 2016). Besides a ‘whipping boy’ was found - Personnel Department of Investigation Directorate of IC across the Novgorod Region. According to Gilina's order functional audit check “upon untimely prolongation of the employment contract of the head of the Low-Vishera MSO” was initiated.

Thus it turned out that the Personnel Department is guilty that it timely did not report that validity period of powers of the employee ****** expired in 2015. Internal functional audit check established that the management of personnel department not fully performed proper operations on timely prolongation of the labor contract and preparation of necessary documents. Whether it is worth saying that it was performed as blind and to hide illegal orders of Gilina. This employee was not the only one.

From August 1 to November 17, 2016 certain N **** worked in Investigation Directorate according to the works agreement. It is worth mentioning that she was not an employee of Investigation Directorate. But nevertheless, at the request of Gilina, she studied criminal cases, in-house documentation, participated in meetings including the one on investigation of criminal cases, and even went with checks in territorial departments.

But now the destiny of the mentioned criminal cases is more important. Both IC and Prosecutor’s Office are aware of the procedural violations. And dislike of the prosecutor of the Novgorod Region Andrey Kikotya for Gilina transferred to St. Petersburg reached the highest limit. There will be one of these days especially sensitive lawyers who based on articles Codes of Criminal Procedure will demand from courts of review of these criminal cases and cancellation of sentences. And it means loud and extremely unpleasant scandal. Gilina ‘played a dirty trick’ on state accusation, having created a huge lot of extra work for prosecutor's office and big loading for courts.

The management of IC is aware that the investigations were made by the employee who was not appointed to a position by rules. However no obvious reaction followed yet. Salvaging ‘official authority’ of Gilina, most likely, they decided to close eyes to all violations made by her.

Novgorod aspect

In the Novgorod Region as it became clear, already saved from odious Ekaterina Gilina, many still can not say her name, except as with aspiration. The local websites, which dared to publish materials about scandal with Gilina or to repost articles of federal media on this subject, were blocked, it also happened that such articles in general disappeared from the Internet. And in one of the Novgorod groups in VKontakte a user was blocked for attempt to express Gilina's resignation with the formulation “we can get in trouble”. Official mass media reported only Gilina's transfer to St. Petersburg and her rewarding.

In December, 2016 colonel of justice Maxim Lukichev was appointed the head of department of investigation of especially important issues of Investigation Directorated of Investigative Committee of the Russian Federation across the Novgorod Region. And just before Gilina's transfer, the regional government provided the new deputy manager − colonel of justice Stanislav Belyansky who arrived to the Novgorod Region from Khanty-Mansiysk.

So many Novgorodians appeared unaware of a ‘demarche of investigating officers’. Now the ID across the Novgorod Region waits for appointment of the new general in hope that with his receipt the destiny of nine rebelled investigating officers at last will be decided.
