Perm corrupt official sent to court for bringing damage of 36 million rubles to budget
Trial of ex-head of municipal authority begins in the Perm Region.
Former official charged with bribery and abuse of office.
According to the region Investigative Committee of Russia, actions of the former head of local government office led to the fact that the local budget was short of 36 million rubles. Specialists of the second division for investigation of especially important issues and crimes against the state power in the field of economy of the Investigative Directorate of the Investigative Committee of Russia in the Perm Region finished investigation of the criminal case, which was initiated against ex-head of MU Management of Capital Construction of the Perm Municipal District. The official is accused of committing crimes provided by item (c) part 3 Art. 286 of the Criminal Code of the Russian Federation, item (c) part 5 Art. 290 of the CC RF and part 6 Art. 290 of the CC RF. “Commission by an official of actions which transcend the limits of his powers and which involve a substantial violation of the rights and lawful interests of individuals or organisations, or the legally-protected interests of society and the State, with the infliction of grave consequences; Bribe-Taking in the form of money on a large scale for actions (inaction) in favor of a bribe-giver or the persons he/she represents, if such actions (inaction) form part of the functionary's official powers or if the latter, by virtue of his/her official position, may further such actions (inaction), and also for overall patronage or connivance in the civil service”.
During the investigation, experts have determined that on 15 February 2013 a municipal contract was conducted between UKS of the Perm Municipal District and commercial firm connected with accomplishment of reconstruction works in the building of the kindergarten located in the village Pots of Zabolotsky rural settlement. The contract amount exceeded 36 million. The suspected was acting on behalf of the municipality at the conclusion of the contract.
As the regional Investigative Committee noted, the defendant monitored execution of terms of the contract and conducting construction and reconstruction works. Violating the established by normative legal acts order, associated with changes in the project’s documentation, he allowed representatives of the construction company to replace the materials in oral form.
As a result, because of wrongful acts of the official, the kindergarten was constructed with violations of the project’s documentation, because of what the building was unsuitable for use. Despite this, the official signed a number of certificates and acts unreasonably confirming the execution of works in full and evidencing that the municipality had no claims to the quality of the construction. Moreover, he paid for a work, executed in an inadequate way.
Representatives of the Perm Region Investigative Committee emphasize that the actions of the official led to considerable violations of the rights and legitimate interests both of citizens, and the organizations. Furthermore, by his actions, he caused damage to the interests of society and the stateб protected by the lawб and caused damage to the budgets of the Perm Region and the Perm Municipal District the amount of which exceeded 36 million. In addition, by his actions, he prevented the state in implementation of the social program aimed at providing children with free places in kindergarten.
During the investigation, law enforcement authorities found out that in the period from 2010 to 2012 the certain official took bribes twice one of them amounted to 800 thousand rubles, the second – about 1,5 million rubles.
The investigation collected enough proofs confirming criminal activities of the official. Due to this, the criminal case with the approved indictment will be brought to trial for further consideration on the merits.
A federal judge other than retired Catherine Forrest will consider the case of Razhden Shulaya, who is charged with the creation of a criminal syndicate and other crimes, in the Federal District Court of the Southern District of New York.
Ismail Efendiev is suspected of exceeding authority in connection with the investigation of cases of detained earlier former First Deputy Prime Minister Ramazan Aliyev and nephew of the former head of Dagestan Askhabali Abdulatipov. Searches are being conducted at Efendiev's office and house.
