"Mostovik" is once again on security forces’ radar
The largest construction company which is now bankrupt NPO "Mostovik" LLC attracted the attention of law enforcement again. As "Kommersant" found out, the Prosecutor's Office in the Omsk Region has revealed that having arrears in wages to former employees, the company which went bankrupt in 2015 was selling its property at a reduced price. At the present time, the investigation against Mostovik’s bankruptcy supervisor Mikhail Kotov is conducted under three articles of the Criminal Code.
The arrears in wages of the scientific-production association "Mostovik" to its former employees for the years 2014-2016 amounts to more than 717 million rubles. This was announced by the Deputy of the State Duma of the Omsk Region Oleg Denisenko, who, at the request of the former employees of the company, sent a request to the supervisory authority.
Also, the Prosecutor's Office confirmed the suspicions of the company’s former employees that the price offered for sale of the property of the bankrupt company is significantly reduced. As reported in the Prosecutor's response, the facts of spending the money in violation of the Federal Law "On Insolvency (Bankruptcy)" were established, which affected on the fact that the company still has not paid its former employees. As a result of the inspection, the Prosecutor's Office’s sent to the Ministry of Internal Affairs of Russia in the Omsk Region the decision to carry out pre-investigation checks on actions of the bankruptcy supervisor of the company under the Art. 160 ("embezzlement"), Part 2 of Art. 195 (wrongful satisfaction of property claims of certain creditors at the expense of the debtor's property), Art. 201 (abuse of power) of the Russian Criminal Code.
According to the Prosecutor's Office, the Mostovik workers have been paid about 2.5 billion rubles, of which 317 million rubles were paid in 2016, including funds from the sale of the bankrupt’s property. The total amount of the debt exceeds 717 million rubles.
In March 2016, the Frunzensky District Court sentenced the CEO of NGO "Mostovik" Oleg Shishov, who concluded the pre-trial agreement on cooperation with the investigation, to 3 years in a penal colony, and mulcted him 300 thousand rubles. According to Shishov’s confessions, Mostovik acts as a general contractor for the construction of the NOC "Primorsky Aquarium" in Vladivostok, Shishov admitted that he was assisted the Ex-Director of the Federal State Unitary Enterprise "Direkcia po stroitelstvu v DFO" Andrey Poplavskiy in embezzling 1 billion rubles allocated for the construction of the research and education complex.
Having built the Olympic facilities in Sochi, immediately after the Olympic Games on April 4, 2014, the Mostovik’s CEO Oleg Shishov filed a bankruptcy petition, the official reason was that the company could not repay the bank loans. Now the company is under liquidation, its liabilities exceed 37 billion rubles.
Sale of the company’s property started in January this year. The bankruptcy supervisor Mikhail Kotov managed to sell cars, machinery, receivables, residential and non-residential real estate, as well as small company assets, including keys, files, men's shoes and labels for cables totaling 455.9 million rubles. It is noteworthy that two companies participated in the auction, but the there was not any real fight for the lots between them: the property was sold at the initial price.
The first two lots of 19.9 million and 18.2 million rubles respectively were bought by Moscow LLC "Florida", established specially for the auction (registered on December 31, 2015, the authorized capital is 80 thousand rubles). The company bought the "Mostovikavia" LLC for 1 ruble. The third and fourth lots of 62.5 million and 29.3 million rubles were bought by the LLCs "Revansh" and "Forward" (these companies have also been established on the eve of trades). Fifth lot was received by the LLC "Avalon" for 209 million rubles. The situation was the same with the Moscow Company "Avalon". On June 14, for RUB 209.4 million (initial price) it bought the Mostovik’s property, included in the fifth lot. The property and receivables of the bridge construction company included in the sixth auction lot was bought on 22 June by the Moscow LLC "Paradigm" at the initial price of 116,6 million rubles.
According to Kommersant, the experts believe that the buyers of Mostovik’s property can be the companies affiliated with its former owners.
Major of the Operative Unit No. 6 in the South-Eastern Administrative District of Moscow, Kirill Dvoretskov, is the nephew of General Boris Pishchulin, who used to head the police of the South-Eastern Administrative District of Moscow.
